Terms and Conditions

This portal at www.constructionchat.co.uk is owned and operated by Ashcon Deveopments ltd of 12 Priestley Way, London, NW2 7AP. If you wish to contact us for general purposes, please write to us at this address or email us at info@constructionchat.co.uk.

These Terms and Conditions govern your use of the Portal. They apply to general visitors to the Portal, as well as to our clients (“Employers”) who may be seeking employees for vacancies and to candidates (“Candidates”) seeking such vacancies.

We may update these Terms and Conditions from time to time for legal or regulatory reasons or in order to ensure that they better reflect our services offered through this Portal. We will make reasonable efforts to indicate on the Portal that changes have been made. We therefore suggest that you review the Portal periodically. If you do not wish to accept the new or amended Terms and Conditions you should not continue to use the Portal. If you continue to use the Portal after the date on which the change comes into effect, your use of the Portal indicates your agreement to be bound by the new Terms and Conditions.

Ashcon Developments is a Recruitment consultancy service and Construction Chat is an educational resource. It is subject to the Conduct of Employment Agencies and Employment Business Regulations 2003 (SI 2003/3319). We do not pay the salaries of Candidates and invoice Employers for such payments. We charge an introduction fee to Employers in the event that they recruit Candidates introduced by Ashcon Developments Ltd to them if such Candidates accept permanent positions. The Portal is made available only as a venue:

1. To enable Employers to advertise their vacancies;

2. To allow Candidates to submit their CVs to Ashcon Developments ltd;

3. To allow Ashcon Developments ltd to select certain Candidates for interview after which we may decide to introduce them to Employer’s.

Please read these Terms and Conditions carefully as they affect your rights and liabilities under the law. IF YOU ACCESS OR USE THE PORTAL, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS. If you do not agree to these Terms and Conditions, please do not use the Portal.

1 Our undertakings
1.1 We will exercise all reasonable care in compiling the contents of the Portal which we provide to you subject to these Terms and Conditions.

1.2 We will use all reasonable efforts to ensure that the Portal is available at all times, but please see the limitations and reservations which we set out in the next section.

2 Limitations and disclaimers
2.1 We provide the Portal only on an “as is” and “as available” basis. We do not represent that access to the Portal or any part of it will be uninterrupted, reliable or error free nor do we represent or warrant that the Portal or its content will be accurate, complete, reliable or suitable for any purpose.

2.2 If you detect any error or fault, you should report it to info@constructionchat,co.uk and we shall attempt to correct the error or the fault, if it can be corrected, as soon as we reasonably can.

2.3 If Construction Chat is informed of any inaccuracies or other apparent errors in the content appearing on the Portal, we shall use our reasonable endeavors to rectify or remove them as soon as possible.

2.4 Your access to the Portal may occasionally be restricted to allow for repairs, maintenance or the introduction of new facilities or services. Ashcon Developments ltd shall make every effort to restore the full functionality of the Portal as soon as possible.

2.5 Ashcon Developments’ ltd liability arising from any faults, errors or inaccuracies is expressly excluded to the fullest extent permitted by law.

2.6 Your use of the Portal is entirely at your own risk. We shall not be liable for any losses whether direct or indirect which you may suffer as a result of any defect in the service including server failure, access delays or interruptions, data non-delivery and delays in provision of services and breaches of security whether arising from unauthorised use or “hacking” or otherwise. We give no warranty that any material you download will be free from infection, viruses and/or other code that has contaminating or destructive properties. You are responsible for implementing sufficient procedures and virus checks for your own protective purposes.

2.7 Construction Chat cannot accept any liability for the content of any CV, email, posting, message, document or other material placed by any Candidate or Employer or other third party on any part of the Portal.

2.8 By submitting information through the Portal you agree and acknowledge that while we may contact you in response to the information you provide, we are not obliged to provide you with any particular service.

2.9 Ashcon Developments ltd makes no representation or warranty to Candidates in respect of any of the following:

2.9.1 the existence or availability of any appointment advertised on the Portal;

2.9.2 that Ashcon Developments ltd will invite you for interview;

2.9.3 that any Employer we contact with your consent will ask to interview you or subsequently recruit you;

2.9.4 that any Employer will keep confidential any information about you provided to that Employer; or

2.9.5 the final terms and duration of any appointment obtained by means of the Portal.

2.10 If we are in breach of these Terms and Conditions, we will only be responsible for any losses that you suffer to the extent that they are a foreseeable consequence to both of us. Our liability shall not in any event include business or consequential losses such as lost data, lost profits or business interruption.

2.11 None of the exclusions or limitations above shall exclude or restrict our liability for death or personal injury caused by our negligence or limit any statutory rights you may have which cannot be excluded or restricted and each exclusion or limitation shall be construed as a separate and separable provision of these Terms and Conditions.

2.12 Whilst Ashcon developments ltd uses reasonable care in selecting, arranging and presenting the content found on the Portal, it is provided purely for information and you should seek further guidance and make independent enquiries before relying upon it.

2.10 The content of articles and other projects is for informational purposes only and does not constitute professional advice. 

3 Reservations
3.1 We reserve the right at our sole discretion to:

3.1.1 deny access to the Portal or any part of it to you without notice to you whether or not you are in breach of these Terms and Conditions;

3.1.2 deny your access to any other portal or website under Ashcon developments ltd’s control without notice to you;?

3.1.3 modify or withdraw, temporarily or permanently, the Portal in whole or in part without notice to you.

4 Candidate registration
4.1 If you are a Candidate, in order to access to receive “job opportunities” you must register on the Portal. If you register, you must ensure that the details provided by you on registration or at any time are correct and complete.

4.2 You must inform us immediately of any changes to the information that you provided when registering by updating your personal details in order that we can communicate with you effectively.

5 Right to suspend or cancel your registration
5.1 We may suspend or cancel your Candidate registration immediately at our reasonable discretion or if you breach any of your obligations under these Terms and Conditions.

5.2 You can cancel your registration at any time by logging onto the Portal through the “unsubscribe” link contained in the last “job opportunities” email you received.

5.3 The suspension or cancellation of your registration and your right to use the Portal shall not affect either party’s statutory rights or liabilities.

6 Data protection
6.1 No CV or other information which contains “personal data” about you as a Candidate shall be disclosed or made available to employers without your express consent. “Personal data” shall mean data identifying you or from which you may be identified and the phrase is further explained by the Data Protection Act 1998 (“the Act”).

6.2 Further terms regarding the way in which we handle your personal data are to be found in our Privacy Policy [link to Privacy Policy].

7 Employers
7.1 You are entitled to place details of employment vacancies you have which are open to Candidates as well as display on the Portal other advertising, whether branded or otherwise. Candidates who may be interested in your vacancies may contact Construction Chat with an expression of interest which we shall pass on to you with the Candidates’ consent.

7.2 Ashcon Development ltd may interview any Candidates as we see fit and recommend them to you. If we do, we warrant that we have obtained such Candidates’ consent to contact you and send you any CV or other information.

7.3 Construction Chat is not liable in any way for any errors or omissions or other defects in the content of any information about Candidates which we may provide to you.

7.4 If we recommend a Candidate to you and obtain such Candidate’s consent to disclose personal data relating to that Candidate to you, you acknowledge that Construction Chat is the “data controller” (as defined in the Act) in relation to such personal data and agree that you shall take all appropriate technical and organisational measures against the unauthorised or unlawful processing of any personal data of Candidates and against the accidental loss or destruction of, or damage to such personal data inclusive of adequate backup procedures and disaster recovery systems and steps to ensure the reliability of your staff having access to the personal data.

7.5 In addition, you agree to comply with the provisions and principles of the Act generally, inclusive of all subordinate legislation made under it. You will promptly provide to Ashcon Developments ltd on request all personal data under your control in the event that Ashcon developments ltd is served with a subject access request under the Act.

8 Intellectual Property
8.1 All information and content on the Portal inclusive of design, text, graphics, source code or other material and the selection and arrangement of it is owned or licensed by Ashcon Developments ltd. You may retrieve and display the content of the Portal on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the Portal without prior written permission from Ashcon Developments ltd.

8.2 We grant you permission to copy electronically and print in hard copy portions of the Portal solely in connection with your own private information gathering purposes. Any other use of the Portal content (including reproduction for purposes other than those noted above and alteration, modification, distribution or re-publication) without our prior written permission is strictly prohibited.

8.3 You warrant that you are entitled to permit BMS to place text and graphics relating to your vacancies or other advertising on the Portal and that you own, or have secured any necessary licences, consents and permissions from the owners of all relevant intellectual property inclusive of all copyright, trade marks and design rights in such text and graphics.

9 Events beyond our control
We shall not be liable to you for any breach of these Terms and Conditions or any failure to provide or delay in providing any information service through this Portal relating from any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, break down of systems or network access, fire, explosion or accident.

10 Unenforceability
The enforceability or otherwise of any provisions of these Terms and Conditions shall not affect the enforceability of the rest of these Terms and Conditions.

11 Waiver
If you breach these Terms and Conditions and Ashcon Developments ltd chooses to ignore the breach or take no action, this does not constitute a waiver of the term or right or remedy and shall not effect our entitlement to rely on any right and remedy at a later date.

12 Third parties
Nothing in these Terms and Conditions shall create any right or entitlement, whether pursuant to the Contracts (Rights of Third Parties) Act 1999 or otherwise, in favour of any person other than you and BMS.

13 Disputes and applicable law
13.1 These Terms and Conditions will be subject to the laws of England and Wales. We will try to resolve any disagreements quickly and efficiently. If you are not happy with the way we deal with any problem or if in any event you need to take court proceedings, you must do so in the courts of England and Wales.

13.2 This Portal is controlled and operated by Ashcon Developments ltd in England. We have used our reasonable endeavors to ensure that it complies with the laws prevailing in the United Kingdom of Great Britain and Northern Ireland but Ashcon developments ltd makes no representation that the material on the Portal are appropriate or available for use in jurisdictions other than the United Kingdom. If you are visiting the Portal from elsewhere, you do so on your own initiative and you are responsible for compliance with any applicable laws.
